USMCA Appendix 1603.D.1 (fka NAFTA)

The USMCA (fka NAFTA) permits qualified Canadian and Mexican citizens to seek temporary entry into the United States to engage in business activities at a professional level.

TN Visa for Canadian and Mexican Professionals

  • The eligibility requirements for a TN assignment are as follows:

     

    • The assignment must be professional and listed in the USMCA;

    • You must hold the proper educational degree closely related to the field of the offered position or license to be considered a professional as stated in the USMCA and/or you must have the requisite professional experience, if applicable;

    • You must qualify as a business person as the term is defined in the USMCA;

    • You must be a citizen of Canada or Mexico; and

    • You must seek temporary entry.

     

    Professional Assignment: All the permissible TN occupations are listed in the USMCA Treaty. You may not provide services in other unlisted occupations. The TN assignment must have a worksite in the United States, including the District of Columbia and Puerto Rico. The TN classification may be used for part-time employment. However, the TN may not be used for self-employment.

     

    Qualifications: All but a handful of the TN classifications require that you hold either a baccalaureate or licenciatura degree. A baccalaureate or Licenciatura degree is the minimum requirement for these professions unless an alternative credential is otherwise specified. A three-year degree is acceptable. For 13 professions, you may present a valid state or provincial license instead of a degree. Evidence of licensure for these professions is an alternative to educational documents and not a requirement for admission in addition to educational documents. An additional seven professions allow the foreign national to qualify by presenting a post-secondary certificate or diploma and evidence of professional experience instead of a baccalaureate or licenciatura degree. See the Education/Experience and TN Professions section for specific information regarding each profession.

     

    Business Person: You must seek to engage in business activities at a professional level which means the performance of prearranged business activities for a U.S. entity, including an individual.

     

    Citizenship: You must submit proof of Canadian or Mexican citizenship. Persons holding permanent resident status in Canada or Mexico are not eligible for TN classification. Dependent spouses and children, however, need not be citizens of Canada or Mexico.

     

    Temporary Entry: Temporary entry, as defined in the NAFTA, means entry without the intent to establish permanent residence. You must satisfy to the inspecting immigration officer that your proposed stay is temporary. A temporary period has a reasonable, finite end that does not equate to permanent residence. In order to establish that your entry will be temporary, you must demonstrate to the satisfaction of the inspecting immigration officer that your work assignment in the United States will end at a predictable time and that you will depart upon completion of the assignment. 8 CFR §214.6(b)

     

    While there is no specific limit on the total period of time a citizen of Canada or Mexico may remain in TN status, the TN classification is nevertheless for persons seeking temporary entry without the intent to establish permanent residence.

  • General Requirements: Under USMCA, an applicant seeking classification as a TN must demonstrate business activity at a professional level in one of the professions or occupations listed in Appendix 1603.D.1 set forth at 8 CFR 214.6(c).  A Baccalaureate (bachelor’s) or Licenciatura degree is the minimum requirement for these professions unless an alternative credential is otherwise specified. A three-year degree is acceptable.

     

    Degrees Earned Outside North America: Degrees received by the applicant from an educational institution not located within Canada, Mexico, or the United States must be accompanied by an evaluation by a reliable credentials evaluation service which specializes in evaluating foreign educational credentials. The same requirement applies to diplomas and certificates earned outside the United States, Canada, and Mexico.

     

    Equivalencies: Where a bachelor’s degree is required, experience cannot be used in lieu of the degree. Equivalencies based upon a combination of education and experience also cannot substitute for a degree when a specific degree is required.  

     

    State or Provincial License: The terms state/provincial license and state/provincial/federal license means any document issued by a state, provincial, or federal government, as the case may be, or under its authority, but not by a local government, that permits a person to engage in a regulated activity or profession.   

     

    Licensure: Proof of licensure to practice a given profession in the United States may be offered along with a job offer letter or other documentation in support of an application for TN classification.  But admission/classification must not be denied based solely on the fact that the applicant does not already hold a license to practice in the United States (with the exception of Nurses). Licensure to practice a given profession in the United States is a post-entry requirement subject to enforcement by the appropriate state or other non-Federal authority. 9 FAM 402.17-4(B).

     

    Post Secondary Diploma: A Post Secondary Diploma means a credential issued, on completion of two or more years of post-secondary education, by an accredited academic institution in Canada or the United States.  


    Post Secondary Certificate: A Post Secondary Certificate means a certificate issued, on completion of two or more years of post-secondary education at an academic institution, by the federal government of Mexico or a state government in Mexico, an academic institution recognized by the federal government or a state government, or an academic institution created by federal or state law.

  • A business person is ineligible for classification as a TN Professional if the enterprise in the United States offering a contract or employment to the business person seeking entry is a sole proprietorship operated by that business person.  

     

    Moreover, even if the receiving enterprise is legally distinct from the business person, such as a corporation having a separate legal existence, entry as a TN Professional must be refused if the receiving enterprise is substantially controlled by that business person

     

    Whether the business person “substantially controls” the U.S. enterprise will depend on the specific facts of each case.  The following factors, among others, are relevant in determining what constitutes substantial control:

     

    • whether the applicant has established the receiving enterprise;

    • whether, as a matter of fact, the applicant has sole or primary control of the U.S. enterprise (regardless of the applicant’s actual percentage of share ownership);

    • whether the applicant is the sole or primary owner of the business; or

    • whether the applicant is the sole or primary recipient of income of the business.

  • Certain foreign health care workers must present a health care certificate from an approved agency in order to be admissible in TN status:

     

    • Registered Nurses; 

    • Occupational Therapists; 

    • Physiotherapist/Physical Therapists; and

    • Medical Technologists/Technicians (Clinical Laboratory Scientists/Technicians).

    Registered Nurses: May satisfy the certificate requirement with one of two documents issued by the Commission on Graduates of Foreign Nursing Schools (CGFNS), as CGFNS is currently the only approved agency. The VisaScreen Certificate satisfies the standard statutory and regulatory requirements for certification, discussed above. There is also a VisaScreen streamlined process for graduates of entry-level programs accredited by the National League for Nursing Accreditation Commission (NLNAC) or the Commission on Collegiate Nursing Education (CCNE), as these foreign nationals are exempt from the educational comparability review and English language proficiency testing.

     

    Occupational Therapists: Must obtain either the VisaScreen certificate from CGFNS, or a Visa Credential Verification Certificate from the National Board for Certification in Occupational Therapy (NCBOT). The practitioner should note, however, that NBCOT “is authorized to issue certificates in the field of occupational therapy pending final adjudication of its credentialing status.” There is a streamlined process if the foreign national “graduated from a program accredited by the Accreditation Council for Occupational Therapy Education (ACOTE) of the American Occupational Therapy Association (AOTA),” because the educational comparability review and English language proficiency testing need not be performed. 


    Physiotherapist/Physical Therapists: A VisaScreen Certificate from CGFNS or a Comprehensive Credentials Evaluation from the Foreign Credentialing Commission on Physical Therapy (FCCPT) will suffice. At least one state requires a different type of certificate, even though the certificate is an application in addition to the state licensure application. In addition, a foreign national who “graduated from a program accredited by the Commission on Accreditation in Physical Therapy Education (CAPTE) of the American Physical Therapy Association (APTA) is exempt from the educational comparability review and English language proficiency testing.

  • Canadian citizens are visa exempt. You may apply for TN status either:

     

    • In person with US Customs and Border Protection (CBP) at a Port of Entry or Preflight Inspection; or

    • By mail with US Citizenships and Immigration Services (USCIS).

    Apply in person with CBP at a port of entry

    Although Canadian citizens can apply for TN status at any port of entry or preflight inspection location, fourteen ports of entry are designated for optimized processing.

     

    The following is required to apply for TN status with CBP:

     

    • Passport (Proof of Citizenship)

    • Employer Support Letter

      • Job title

      • Detailed job description

      • Source(s) of remuneration, salary, and benefits

      • Duration of employment

      • Must be on company letterhead with original signature

    • Evidence of Qualifications

      • Original degree

      • If a degree is obtained outside of North America, you must include an accredited evaluation and translation (if necessary)

      • Sealed transcripts

      • Proof of experience / qualifications, if applicable

    • Other Evidence, if applicable

      • Visa Screen (healthcare workers)

      • State License

      • Waiver of Inadmissibility

    • Dependents

      • Marriage License

      • Birth Certificates of children

      • TD visa (non-Canadian family)

    What if I am traveling to the U.S. from somewhere other than Canada? While it is advisable to apply through an optimized port of entry or preflight inspection location, Canadian citizens can apply for TN status through CBP at port of entry on the southern border or any international airport in the U.S.
     

    Apply by mail with USCIS

    A TN employer can file on behalf of a Canadian citizen who is outside the U.S. by submitting Form I-129 along with the Trade Agreement Supplement. The filing fee is $460 USD. For current processing times check here. Premium Processing is available for an additional fee of $2,500.

     

    If USCIS approves the Form I-129 the TN worker will take the approval notice and apply for admission with CBP at a port of entry or preflight inspection location. The TN worker should carry a complete copy of the petition submitted to USCIS in case CBP has any questions.

     

    If a Canadian citizen is inside the U.S. in another status (such as F1, or B1) a TN employer can submit a Form I-129 along with the Trade Agreement Supplement to request the TN worker’s status be changed to TN.

  • Mexican citizens must apply for a TN visa at a U.S. embassy or consulate abroad in order to enter the U.S. in TN status. There are two parts to the visa application:

     

    1. The TN worker must first complete a DS-160, Nonimmigrant Visa Application.

    2. The TN worker can then schedule an appointment via US Visa Info.

     

    The nonimmigrant visa application processing fee is $185 USD. This fee cannot be paid online but must be paid at a bank in Mexico. Currently only three locations in Mexico accept TN visa applications which are the U.S. embassy in Mexico City and the consulates in Ciudad Juarez and Guadalajara.

     

    Please see the section “Apply in person with CBP at a port of entry” for a TN checklist. If the TN worker earned their degree in Mexico, they must have their professional cedula from the Secretary of Public Education, Administrative Office for Professions / Careers.

     

    If the TN visa application is approved, the TN worker can receive a one-year or four-year visa. The TN worker will be asked to pay a TN reciprocity fee of $79 or $357 USD based on the visa length selected. 

     

    When the TN worker enters the U.S., they will receive up to three (3) years of TN status. The TN worker can verify their TN status (I-94 admission record) online.

     

    A TN employer can also file on behalf of a Mexican citizen who is inside the U.S. in valid status by submitting Form I-129 along with the Trade Agreement Supplement. The filing fee is $460 USD. For current processing times check here. Premium Processing is available for an additional fee of $2,500.

     

    The Form I-129 can be filed as a change of employer if the TN worker is already in TN status for another employer, or as a change of status if the TN worker is in the U.S. in another status (such as F-1 or B-1). If approved, the TN worker will receive a new status document reflected the change of employer or status. Please note that an approval notice is NOT a visa. So, while the TN worker can now work for their TN employer, their ability to travel may be limited.

  • Can my family come to U.S with me? Yes, a spouse and children under the age of 21 can apply for TD status (Canadian) or a TN visa (Mexican) to accompany the principal TN holder.

     

    How long can my family stay in the U.S.? Spouses and children are entitled to the same visa and status length as the principal TN holder.

     

    Can my spouse or children work in the U.S.? No, TD status does not grant work authorization.

     

    Can my spouse or children attend school in the U.S.? Yes, TD status does allow a spouse and children to attend school in the U.S., including public school.

     

    What if my spouse or children are not Mexican or Canadian citizens? As long as the principal TN holder is eligible for a TN visa or status, their spouse and children can receive a TD visa or status. Since Canadians are visa exempt, if their spouse or children are not Canadian citizens, they must apply for a TD visa at a U.S. embassy or consulate abroad. 

  • A TN employer support letter must include the following:

     

    • The profession of the applicant under Appendix 2 to Annex 16–A of Chapter 16 of the USMCA; 

    • A description of the professional activities, including a brief summary of daily job duties, if appropriate, in which the applicant will engage in for the United States employer/entity; 

    • The anticipated length of stay; 

    • The educational qualifications or appropriate credentials which demonstrate that the Canadian or Mexican citizen has professional level status; and 

    • The arrangements for remuneration for services to be rendered.

General TN Requirements

  • Job Description: Accountants and auditors prepare and examine financial records, identify potential areas of opportunity and risk, and provide solutions for businesses and individuals. They ensure that financial records are accurate, that financial and data risks are evaluated, and that taxes are paid properly. They also assess financial operations and work to help ensure that organizations run efficiently. 

     

    TN Requirements:

     

    • Baccalaureate/Licenciatura Degree in a closely related field; or

    • C.P.A., C.A., C.G.A., or C.M.A.

     

    Education: Accountants and auditors typically need a bachelor's degree in accounting or a related field, such as business. Some employers prefer to hire applicants who have a master’s degree, either in accounting or in business administration with a concentration in accounting.

  • Job Description: Architects plan and design houses, factories, office buildings, and other structures.

  • Job Description: Computer systems analysts, sometimes called systems architects, study an organization’s current computer systems and procedures and design improvements to them. In doing so, these analysts help the organization operate more efficiently.

     

    TN Requirements:

    • Baccalaureate/Licenciatura Degree in a closely related field; or

    • Post-Secondary Diploma/Post-Secondary Certificate and three years experience.

     

    Education: Computer systems analysts typically need a bachelor’s degree to enter the occupation. Studying a computer science or information systems field is common, although not always a requirement. Some firms hire job candidates who have a degree in business or liberal arts along with relevant skills.

    Notes: CSA category does not include programmers.  A systems analyst is an information specialist who analyzes how data processing can be applied to the specific needs of users and who designs and implements computer-based processing systems.  Systems analysts study the organization itself to identify its information needs and design computer systems which meet those needs.  Although the systems analyst will do some programming, the TN category has not been expanded to include programmers.

  • Job Description: Claims adjusters, appraisers, examiners, and investigators evaluate insurance claims. They decide whether an insurance company must pay a claim and if so, how much.

     

    TN Requirements:

    • Baccalaureate/Licenciatura Degree and successful completion of training in the appropriate areas of insurance adjustment pertaining to disaster relief claims; or

    • Three years’ experience in claims adjustment and successful completion of training in the appropriate areas of insurance adjustment pertaining to disaster relief claims.

     

    Education: A high school diploma or equivalent is typically required for a person to work as an entry-level claims adjuster or examiner. However, employers sometimes prefer to hire applicants who have a bachelor’s degree or some insurance-related work experience.

  • Job Description: Librarians and library media specialists help people find information and conduct research for personal and professional use. Their job duties may change based on the type of setting they work in, such as public, school, or medical libraries.

     

    TN Requirements: M.L.S. or B.L.S. (for which another Baccalaureate or Licenciatura Degree was a prerequisite).

     

    Education: Librarians typically need a master’s degree in library science (MLS). School librarians and library media specialists typically need a bachelor’s or master’s degree in a related field, along with a teaching certificate; requirements vary by state.

  • Job Description: Management analysts, often called management consultants, recommend ways to improve an organization’s efficiency. They advise managers on how to make organizations more profitable through reduced costs and increased revenues. Management analysts often specialize in certain areas, such as inventory control or reorganizing corporate structures for efficiency. Some focus on a specific industry, such as healthcare or telecommunications. In government, management analysts usually specialize by type of agency.

     

    TN Requirements:

    • Baccalaureate/Licenciatura Degree in a closely related field; or

    • Equivalent professional experience as established by statement or professional credential attesting to five years experience as a management consultant; or

    • Five years experience in a field of specialty related to the consulting agreement.

     

    Education: A bachelor’s degree is the typical entry-level requirement for management analysts. Management analysts address a range of topics, and many fields of study provide a suitable educational background. Fields of bachelor's degree study may include business, social science, and engineering.

     

    Notes: Management Consultants provide services which are directed toward improving the managerial, operating, and economic performance of public and private entities by analyzing and resolving strategic and operating problems and thereby improving the entity’s goals, objectives, policies, strategies, administration, organization, and operation.

     

    Management consultants are usually (1) independent contractors providing services to the U.S. company or (2) employees of consulting firms providing services on behalf of the U.S company. 

     

    Management consultants providing services to the U.S company can be salaried employees only when they are not assuming existing positions or filling newly created positions. As a salaried employee of the U.S. company, they may only fill supernumerary temporary positions. On the other hand, if the employer is a U.S. management consulting firm, the employee may be coming temporarily to fill a permanent position.
